TERMS OF SERVICE

These Terms of Service (Terms) describes the terms that govern your use of the My Valet Application and the associated Website MyValetgo.com and the services they provide (collectively, “App”) provided by My Valet, Inc. (“My Valet,” “we” or “our”) These Terms do not describe how we collect, use, process and transfer your personal data. For more information about our privacy practices, view our privacy policy.

1. General
1.1 If you choose to use App, you will be agreeing to all of the terms of these Terms between you and My Valet.
1.2 We may amend these Terms at any time, which shall become effective immediately upon posting to this page with a new effective date. You are responsible for reviewing these Terms and by continuing to use this Site, you agree to any changes.
1.3 If any of these Terms are unacceptable to you, you may cease using the App.
1.4 We may change, suspend or discontinue the App at any time. We may also impose limits without notice or liability.

2. App Content
2.1 All App is protected by copyright and other Intellectual Property Rights that are owned or controlled by My Valet or the credited party, unless federal or other applicable law requires otherwise (such as for court proceedings and governmental reports). “Intellectual Property Rights” means the rights relating to anything customarily considered intellectual property, including patents, inventions, trademarks, service marks, brands, logos, corporate names, know-how and trade secrets, copyrights, designs and software.
2.2 To the extent the App is protected by Intellectual Property Rights, you may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create new works from, distribute, perform, display, or in any way exploit, any of the App in whole or in part.
2.3 My Valet will not be liable for any delays, inaccuracies, errors or omissions caused by use of the App or in the transmission or delivery of all or any part of the Content.

3. User Generated Content
3.1 You shall not upload any information that is untrue, inaccurate or otherwise deceptive.
3.2 You shall not, without the express approval of My Valet, use the App to distribute or otherwise publish any material containing any solicitation of funds, advertising or solicitation for goods or services.
3.3 You acknowledge that any submission of information to the App may be edited, removed and displayed by My Valet.
3.4 My Valet reserves the right to delete or modify any information, that in its sole discretion, is deemed to be abusive, in violation of Intellectual Property Rights or otherwise unacceptable to us.

4. Use of App
4.1 You may not access or use, or attempt to access or use, the App to take any action that could harm us or a third party.
4.2 You may not access parts of the App to which you are not authorized. You are not permitted to may not attempt to circumvent any restriction or condition imposed on your use or access or do anything that could disable or damage the functioning or appearance of the App, which includes presentation or display of advertising.
4.3 Engage in unauthorized scraping or any other harvesting or collecting of personal data or use any unauthorized automated means to compile personal data.
4.4 Being exposed to advertising is a condition of using the App.
4.5 The App links to third party Apps, apps and other services “Linked Sites”. We are not responsible for the availability of Linked Sites and My Valet does not endorse, sponsor, recommend, or otherwise accept responsibility for any Linked Sites.

5. Representations and Warranties
5.1 You represent, warrant and covenant that the information you submit will not (a) violate, plagiarize or infringe upon the legal rights of any third party, including Intellectual Property Rights or (b) contain otherwise unlawful or illegal material.
5.2 You represent, warrant and covenant that as a user, you are at least sixteen years old.
5.3 You indemnify, defend and hold harmless My Valet and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you or any user of your account of these Terms. You shall cooperate as fully as reasonably requested in the defense of any such claim. My Valet reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification under this Section 5.3.
5.4 IN NO EVENT WILL MY VALET BE LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS, USE, MISUSE OR INABILITY TO USE APP OR IN CONNECTION WITH ANY FAILURE OF PERFORMANCE, ERROR, TRANSMISSION, COMPUTER VIRUS OR SYSTEM FAILURE.
5.5 THE APP IS PROVIDED “AS IS.” WE DO NOT WARRANT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. THERE MAY BE DELAYS, OMISSIONS, INTERRUPTIONS AND INACCURACIES. MY VALET DISCLAIMS TO THE MAXIMUM EXTENT PERMITTED BY LAW ANY AND ALL SUCH REPRESENTATIONS AND WARRANTIES. WITHOUT LIMITATION OF THE GENERALITY OF THE PREVIOUS SENTENCE, MY VALET DISCLAIMS TO THE MAXIMUM EXTENT PERMITTED BY LAW ANY AND ALL (A) WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, (B) WARRANTIES AGAINST INFRINGEMENT OF ANY INTELLECTUAL PROPERTY RIGHTS, (C) WARRANTIES RELATING TO THE TRANSMISSION OR DELIVERY OF APP, (D) WARRANTIES RELATING TO THE ACCURACY, RELIABILITY, CORRECTNESS, TIMELINESS OR COMPLETENESS OF DATA ON THE APP. THERE IS NO WARRANTY THAT THE SERVICES WILL MEET YOUR NEEDS OR REQUIREMENTS OR THE NEEDS OR REQUIREMENTS OF ANY OTHER PERSON.

6. Registration
6.1 As part of creating an account or submitting information, you will create login identification and a password. You may also be asked to provide information to be used for security or identification purposes. This information must be accurate and you are obligated to keep it up to date. You are not allowed to share your account information with anyone else. We may terminate your use of the App if you share your account information.
6.2 You are responsible for maintaining account information confidential. Failure to comply with the foregoing shall constitute a breach of these Terms, which may result in immediate suspense or termination of your account.
6.3 You may not (i) select or use account information of another person with the intent to impersonate that person; (ii) use account information in which another person has rights without that person written (including electronic) authorization or (iii) use account information we, in our sole discretion, deem offensive or otherwise inappropriate.
6.4 Notify Info@MyValetgo.com if you know of or suspect unauthorized use of your account or any known or suspected breach of security.
6.5 You must be 16 years or older to use the App.
6.6 You are responsible for all use and activity on your account, including use by any third party authorized by you to use your login credentials. Any fraudulent, abusive or otherwise illegal activity may be grounds for termination of your use of the App and, at our sole discretion, we may refer you to appropriate law enforcement agencies.

7. Fees
We reserve the right at any time to charge fees for access to some or all of the App. You will be charged only after we obtain your prior agreement to pay. You may cancel your account at any time.

8. Termination
8.1 You may terminate your account at any time by email notice to Info@MyValetgo.com.
8.2 My Valet may, in its sole discretion, terminate or suspend your access to all or part of the App for any reason, including, without limitation, breach or assignment of these Terms.

9. Miscellaneous
9.1 These Terms are governed by Illinois law, to the extent not superseded by federal law. Any action to enforce these Terms shall be brought in the Cook County or the Northern District Court of Illinois.
9.2 Nothing in these Terms preempt or supersedes the Privacy Notice. In the event of an inconsistency between these Terms and the Privacy Notice, the Privacy Notice shall control.

10. Refund Policy
10.1 Parking location check-ins can be canceled within the first 5 minutes of parking. Following the start of the 5th minute, all parking check-ins are non-refundable, regardless of use or non-use of the Parking location and regardless of any circumstances surrounding the use or non-use of the Parking location (i.e., change of plans, wrong location, weather, or cancellation of a related event).
